General Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter the “GTC”) govern the sale of products and services by Table Indienne, a micro-enterprise with its registered office in Wittisheim, France (hereinafter “Table Indienne” or ‘We’), via its website www.table-indienne.fr (hereinafter the “Site”).

Any order placed on the Site implies full and unreserved acceptance by the customer (hereinafter the “Customer” or “You”) of these GTC. By confirming your order, you acknowledge that you have read and accepted these GTC without restriction or reservation.

Table Indienne reserves the right to modify these GTC at any time. The applicable GTC are those in force on the date of the order.

1. Products and Services Offered

Table Indienne offers for sale on its Site ready-to-cook Indian cooking kits, block printing supplies, home cooking workshops, block printing workshops, and the organization of trips to India.

Each product and service is presented on the Website with a description of its essential characteristics, price, and, where applicable, the specific conditions for its provision (for workshops and trips). The photographs of the products are as accurate as possible but cannot guarantee a perfect similarity with the product offered, particularly with regard to the colors or shades of handcrafted products.

2. Prices

The prices of our products and services are indicated in US dollars (USD), including all taxes (TTC), excluding delivery costs. Delivery costs are calculated and displayed before the final confirmation of the order, depending on the shipping method chosen and the destination.

Table Indienne reserves the right to modify its prices at any time, but products and services will be invoiced on the basis of the prices in effect at the time of order confirmation.

3. Order

To place an order on the Site, the Customer must follow these steps:
  • Select products/services: Add the desired items to your cart.
  • Confirming the basket: Check the selected items and quantities.
  • Logging in or creating an account: Log in to your customer account or create one if you do not have one.
  • Choosing the delivery method: Select the desired delivery option.
  • Choosing the payment method: Select the payment option.
  • Verify your order: A summary of your order (products, prices, delivery costs, total) will be displayed. You will have the opportunity to correct any errors.
  • Accept the Terms and Conditions: Check the box to accept these Terms and Conditions.
  • Final payment confirmation: Confirm your order by making the payment.
Confirmation of the order by the Customer constitutes express acceptance of the prices and descriptions of the products and services available for sale, as well as these Terms and Conditions. An order confirmation email will be sent to you as soon as possible, summarizing the details of your order.

4. Payment

Payment for orders is made online, via the secure payment methods offered on the Website:
  • Credit cards (Visa, MasterCard, etc.)
  • PayPal
  • Bank transfer (for which the order will be processed after receipt of funds)
For workshops and cooking classes, cash payment is possible on site.

Your order will only be confirmed and prepared after payment has been confirmed. In the event of non-payment or refusal of payment authorization by the banking institutions, Table Indienne reserves the right to cancel the order.

6. Right of Withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to justify their reasons or pay any penalties.

How to exercise your right:

To exercise your right of withdrawal, you must notify us of your decision by means of an unambiguous statement (e.g., letter sent by post, fax, or email) to the following address: contact@table-indienne.fr. You may use the standard withdrawal form, although this is not mandatory.

Returning products:

Products must be returned to Table Indienne in new condition, complete and in their original packaging, no later than 14 days after you have notified us of your decision to withdraw. The customer is responsible for the cost of returning the products.

Refund:

If you exercise your right of withdrawal, Table Indienne will refund you the full amount paid (product price and initial standard delivery costs) within 14 days of receiving the returned products or proof of their shipment. The refund will be made using the same payment method used for the initial transaction, unless the Customer expressly agrees to another method.

Exceptions to the right of withdrawal:

In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised for:
Goods that are likely to deteriorate or expire rapidly (in particular certain ingredients in our kits if they were sold fresh).
Goods that have been unsealed by the Customer after delivery and cannot be returned for reasons of hygiene or health protection.
The provision of services that have been fully performed before the end of the withdrawal period and whose performance began after the Customer's prior express agreement and express waiver of their right of withdrawal (applicable to workshops and trips).

7. Legal Guarantees

All products sold by Table Indienne are covered by the legal guarantee of conformity (Articles L.217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code).
Legal guarantee of conformity: Table Indienne undertakes to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. You have a period of two years from the date of delivery of the goods to take action. You are exempt from proving the existence of the lack of conformity during the 24 months following delivery of the goods (for new goods). In the event of a lack of conformity, you may choose between repair or replacement of the goods, or, failing that, a price reduction or termination of the contract.
Warranty against hidden defects: Table Indienne is bound by the warranty against hidden defects in the item sold that render it unfit for its intended use, or that diminish its use to such an extent that the Customer would not have purchased it, or would have paid a lower price for it, had they been aware of them. Any action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.

8. Availability of Products and Services

Our products and services are offered subject to availability for physical products and available places for workshops and trips. If a product is unavailable after you have placed your order, we will inform you by email as soon as possible. You will then have the option to cancel your order and receive a refund, or choose a substitute product.

9. Liability

Table Indienne cannot be held liable for any inconvenience or damage inherent in the use of the Internet, including service interruption, external intrusion, or the presence of computer viruses.

With regard to physical products, Table Indienne's liability is limited to the amount of the order and cannot be held liable for indirect damages.

With regard to services (workshops, trips), the specific liability conditions will be detailed in the associated contracts or booking confirmations.

10. Protection of Personal Data

The Customer's personal information and data are necessary for the management of the order and commercial relations. They are collected and processed in accordance with our Privacy Policy, which complies with the General Data Protection Regulation (GDPR). We invite you to consult it.

11. Cookies

The Site uses cookies to improve the user experience. For more information on the use of cookies and how to manage them, please consult our Cookie Policy.

12. Force Majeure

Table Indienne cannot be held liable for the non-performance or delay in the performance of its obligations in the event of a force majeure event, as defined by French case law.

13. Proof

The computerized records stored in the computer systems of Table Indienne and its partners under reasonable security conditions shall be considered as proof of communications, orders, and payments between the parties.

14. Dispute Resolution

These Terms and Conditions are subject to French law. In the event of a dispute, the Customer must first contact Table Indienne to seek an amicable solution.

In accordance with Articles L.612-1 et seq. of the French Consumer Code, if the amicable request to our customer service department is unsuccessful, the Customer may seek the assistance of a consumer mediator free of charge. In the absence of an amicable agreement, the dispute will be brought before the competent French courts of the place where Table Indienne has its registered office (Strasbourg).

15. Changes to the T&Cs

Table Indienne reserves the right to adapt or modify these T&Cs at any time. In the event of a change, the T&Cs applicable to the Customer's order are those in force on the day the order is confirmed.
